MamaCat & Co Creations – Terms of Service

Welcome to MamaCat & Co Creations. By purchasing products from us, you agree to the following Terms of Service. Please read them carefully before placing an order.


1. Acceptance of Terms

By placing an order with MamaCat & Co Creations, you acknowledge that you have read, understood, and agreed to these Terms of Service, our Return & Refund Policy, and any additional policies published by us.


2. Products

MamaCat & Co Creations offers handmade products including, but not limited to:

  • Snow Globe Tumblers
  • Glitter Tumblers
  • Custom Cups
  • Libbey Wraps
  • Keychains
  • Mystery Boxes
  • Other handmade craft items

As all items are handmade, slight variations in colour, glitter placement, images, and finishes may occur. These variations are not considered defects.


3. Custom Orders

For custom orders:

  • Customers are responsible for providing accurate information, including names, wording, colours, and design preferences.
  • Design proofs may be provided before production where applicable.
  • Approval of a proof confirms acceptance of the design.
  • Changes requested after approval may incur additional charges.
  • Once production has commenced, custom orders cannot be cancelled.


4. Pricing and Payments

  • All prices are listed in Australian Dollars (AUD).
  • Full payment is required before production or shipping unless otherwise agreed.
  • Prices may change without notice.
  • Promotional pricing and discounts are available for limited periods only.


5. Production Timeframes

As products are handmade, production times may vary.

Estimated production times are provided as a guide only and may be affected by:

  • Order volume
  • Material availability
  • Public holidays
  • Personal circumstances
  • Shipping delays outside our control

MamaCat & Co Creations will communicate any significant delays.


6. Shipping

Customers are responsible for providing a correct shipping address.

MamaCat & Co Creations is not responsible for:

  • Incorrect addresses supplied by customers
  • Delays caused by postal or courier services
  • Lost or stolen parcels after delivery has been confirmed

Shipping fees are non-refundable unless required by Australian Consumer Law.


7. Product Care

To maintain the quality of your snow globe tumbler or handmade item:

Tumblers

  • Hand wash only
  • Do not soak
  • Do not place in dishwasher
  • Do not microwave
  • Avoid extreme heat
  • Avoid dropping or impact damage
  • Do not tamper with seals or openings

Failure to follow care instructions may void any replacement consideration.


8. Intellectual Property

All designs, logos, product photographs, branding, graphics, and content created by MamaCat & Co Creations remain the intellectual property of MamaCat & Co Creations unless otherwise agreed in writing.

Customers may not:

  • Copy designs
  • Reproduce artwork
  • Resell designs as their own
  • Use images for commercial purposes without permission


9. Social Media and Marketing

MamaCat & Co Creations may use photographs of completed products for:

  • Social media posts
  • Website listings
  • Promotional materials
  • Marketing campaigns

If you would prefer your custom order not be shared publicly, please notify us before your order is completed.


10. Limitation of Liability

To the maximum extent permitted by law, MamaCat & Co Creations is not liable for:

  • Indirect or consequential losses
  • Damage caused by misuse of products
  • Accidental breakage after delivery
  • Delays caused by third-party shipping providers

Our liability is limited to the purchase price of the product where required by law.


11. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy.

Custom-made items are generally non-refundable unless required under Australian Consumer Law.


12. Australian Consumer Law

Nothing in these Terms of Service excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law.

Customers are entitled to remedies where products fail to meet consumer guarantees under Australian law.


13. Changes to Terms

MamaCat & Co Creations reserves the right to update these Terms of Service at any time.

The latest version will always be available upon request or published on our website and social media platforms.
